A popular restaurant and cafe in Dungarven has been granted permission to continue using a number of outdoor tables in an area which was previously used for public parking. 

Waterford City and County Council has formally granted a further licence under Section 254 of the Planning and Development Act allowing the Shamrock restaurant and café to retain the outdoor dining area.

The application, which was made by the proprietor Uná O'Riordan over the summer, was granted subject to compliance with five conditions (see below).

A planners' report notes the picnic tables are located in the town centre where there is a "stated objective to provide for the development and enhancement of the town core."

A fee of €125 applies for each bench and the licence is valid for 12 months.

The first condition states the proposed development must be carried out in accordance with the planning details received in July unless it is altered in some way by further conditions set out by the council.

The licence is solely for the existing car park spaces as designated in the submitted application papers. Any tables, benches, windbreakers and barriers provided by the licensee are to be provided within this agreed licensed area only.

The footpath fronting the premises must be kept free from obstruction.

The second condition states that the licence is granted for one year from the date of the receipt of permission unless it is otherwise varied, suspended or cancelled by Waterford City and County Council.

The third condition states that the existing planter boxes at the perimeter of the outdoor seating area shall be retained and are not to be interfered with or moved in any way without a written agreement with the District Engineer.

The fourth condition outlined that tables and seating on the premises are not to be used before 8 a.m. and after 8 p.m. every day.

It adds that Waterford City and County Council are the only body permitted to carry out work on the public road and footpath.

Tables, chairs and windbreakers or screens must not be bolted or screw fixed to the public road without the prior written consent of the council.

The licensee is to ensure that the area surrounding the licensed street furniture is free from litter and waste at all times.

The fifth condition states that a copy of the licence and any other conditions attached to the licence are to be prominently displayed at the main entrance outside the restaurant so that it is clearly visible to members of the public and council officials.

The licensee is required to maintain a Public Liability Insurance policy which provides cover to a minimum value of €6.5 million and indemnifies Waterford City and County Council against third party claims.

It adds that furniture and any other items must be removed immediately if ever requested by the council.

Any and all costs incurred by the council, including any repairs to the public road and necessary services arising as a result of the operation of the licence shall be at the expense of the licensee.

Furthermore, the council reserves the right to reduce the licensed area in any particular case where the occupied space is required in the interest of public safety or to facilitate an event during the licence period.
